The United States Judicial Panel on Multidistrict Litigation is considering two federal courts in Texas to centralize all of products liability cases involving the Pinnacle hip devices that are at issue in a growing number of federal lawsuits. It appears that DePuy is receptive to the idea of the MDL being formed in Texas, although they have indicated that they'd prefer the Northern District to the Southern District. An order from the JPML is expected later this month.
According to DePuy, there are currently at least 37 Pinnacle lawsuits that have been filed in 18 district courts across the United States. Should MDL be granted for these cases, all parties involved would benefit through the open sharing of pretrial disclosures, the elimination of inconstant pretrial rulings, and a more streamlined litigation process. MDL status differs from class action status in that MDL plaintiffs maintain individual lawsuits and trials, which increases their chances of obtaining an amount of compensation that corresponds directly with their damages.
